THE JUDICIALIZATION OF MEGAPOLITICS AS A PATH FOR THE ADOPTION OF AN UNPOPULAR ECONOMIC AGENDA

The article examines the relationship between the Judiciary role in president Rousseff’s impeachment and the economic agenda put forward by the Temer government, through the lens of Ran Hirschl’s concept of “Judicialization of Megapolítics”. The article argues that the Brazilian Supreme Court played an active role in the key moments of the impeachment process, creating favourable political conditions for the major economic policy changes brought about by the new unelected government. In light of this, the article re-examines Brazilian literature on the judicialization of politics and explores the explanatory potential of Hirschl’s theory to the Brazilian case.
